Nike is firmly committed to addressing environmental challenges in the world today, both in how we manage our footprint and in the design of our products. We eliminated F-gases across all Nike products following 14 years of research and development in our Nike Air cushioning system. OFFICIAL RULES FOR THE NIKE BEAT GASOLINE CONTEST
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. AMATEUR ATHLETE DISCLOSURE.
Sponsors reserves the right to withhold use of the Submission (defined below) if doing so may compromise a student or amateur athlete's ability to play high school, NCAA college, or other amateur sports. If you currently participate, or plan to participate, in a school-Sponsored or amateur organized sport, participation may affect your eligibility, both immediately and in the future.
2. ELIGIBILITY.
The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are thirteen (13) or older as of as of June 15, 2009, and not currently or planning to be on a high school or college sports team. Participants must also have internet access and a member profile on YouthNoise. Employees of NIKE USA, Inc., its parent company, NIKE, Inc. ('NIKE'), YouthNoise and their subsidiaries and affiliates, or employees of other companies associated with the promotion of the Contest, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.
3. WHO IS SPONSORSING THE CONTEST?
The Contest is sponsored by NIKE USA, Inc., One Bowerman Drive, Beaverton, OR 97005 and YouthNoise, Inc., 1255 Post Street, Suite 1120, San Francisco, CA 94109 (the 'Sponsors').
4. HOW DO I ENTER?
The Contest runs from 12:00 am (PT) on June 15, 2009 to 11:59 pm (PT) on August 15, 2009 (the 'Entry Period'). A winner will be selected each day of the Entry Period. For purposes of the Contest, a day begins at 12:00:00 am (PT) and ends at 11:59:59 pm (PT). During the Entry Period, create a video or take a photo that shows how you use sport to generate energy to fuel your life instead of gasoline and communicate how you are using sport as an alternative to gasoline. Then visit www.youthnoise.com/beatgasoline (the 'Contest Site') and submit your video or photo (the "Submission") following the below Submission Requirements and Guidelines. There is no limit to the number of Submissions a Participant may enter during the Entry Period. Your video or photo must be your own work and entirely original. Entries not meeting the subject matter criteria will not be considered. Sponsors may choose to accept or reject your Submission based on their sole judgment. YouthNoise's computer is deemed the official clock for the promotion. All entries become the property of Sponsors and will not be acknowledged or returned.
5. SUBMISSION REQUIREMENTS AND GUIDELINES.
Video Submission Requirements:
- Cannot wear a team uniform on camera, or mention a team name.
- Must meet subject matter criteria (sport as an alternative to gasoline).
- The following file types are accepted for video entries: .wmv; .mov; .avi; .mpg; .mpeg; .mp4; asf; .3gp; and .3g2
- Must not exceed 200MB in size.
- Must be entirely in the English language.
- Must comply with all Content Restrictions listed below.
Content Restrictions: All Submissions must comply with the YouthNoise Terms of Service located at http://www.YouthNoise.com/TermsOfUse.jsp. The Submission must NOT contain:
- Nudity, lewd or vulgar behavior;
- Material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights;
- Images and/or artwork that that are copyrighted, trademarked, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;
- Gratuitous violence;
- Dangerous stunts;
- Real weapons of any kind, including, but not limited to, guns, knives or projectiles;
- Drug use;
- Smoking;
- Material that is hateful, tortuous, defamatory, slanderous or libelous;
- Material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by Federal, State, or Local Law, Ordinance, or Regulation; and
- Material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created.
Upload Phase: Go to www.youthnoise.com/beatgasoline and follow the links and instructions for Submission. All individuals who desire to participate in the Contest must first create a free YouthNoise.com member profile in order to upload Submissions and thereby be an eligible participant (a "Participant"). Participants who already have a member profile on YouthNoise.com do not need to register again. During the registration process, each Participant will be required to click where indicated to confirm that such Participant agrees to be bound by these Official Rules and Submission Guidelines. Any Submission that includes content that is deemed inappropriate, indecent, obscene or otherwise does not comply with the Content Restrictions listed in above, as determined by Sponsors in their sole discretion, will not be eligible and may be removed from the Contest Site at Sponsors sole discretion. All Submissions become the exclusive property of Sponsors, and no Submissions will be acknowledged or returned. Sponsors shall have the right to edit, adapt, and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the Participant, his/her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES PARTICIPANT'S IRREVOCABLE ASSIGNMENT, CONVEYANCE, AND TRANSFERENCE TO SPONSORS OF ALL RIGHT, TITLE, AND INTEREST IN THE SUBMISSION, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries which are void. In addition, by entering, Participants represent and warrant that the entries that they submit: are their own original creations, do not infringe any other person's or entity's rights, and have not been submitted previously in a contest of any kind. Participants who disregard these Official Rules may be declared ineligible.
Multiple Participants are not permitted to share the same email address. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or Participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winners may be required to show proof of being the authorized account holder. Use of any automated system to participate is prohibited and will result in disqualification. Once a Submission has been submitted for entry, Participants may not under any circumstances temporarily or permanently disable access to the Submission or alter or revise the Submission in any way.
6. JUDGING/REQUIREMENTS OF CONTEST WINNERS.
Winners will be determined by the judging panel assembled by the Sponsors and by online voting at the Contest Site. To vote online the user must be logged into the Contest Site (youthnoise.com/beatgasoline). Within a 24-hour period, user can vote for as many Submissions as they desire; however, they can vote only once per Submission during every 24-hour period. Participants can vote for their own Submission(s). Upon successful vote, user is encouraged to share the Contest and Contest Site with friends.
Weekly Winners of $100 Global Giving Card/T-Shirt: Two winners will be chosen each week during the Entry Period (June 19 and 26; July 3, 10, 17, 24 and 31; and August 7 and 14) to win a $100 Global Giving Card; one of the weekly winners will be determined by the Submission that received the most online votes that week and the other winner will be randomly selected from all Submissions by a computer program. In addition, each week one additional winner will be randomly selected from all Submissions to receive a Beat Gasoline T-Shirt. Weekly winners may win more than one time during the Entry Period.
On or about August 28, 2009, the Sponsors will select three (3) final winners, one each for the Grand Prize, Second Place Prize and Third Place Prize. Winners shall be determined as follows: 50% online voting compiled from the entire Entry Period; 25% creativity and originality, and 25% overall appeal in the Submission, as determined by the judging panel assembled by the Sponsors.
The odds of winning depend on the number of eligible entries received. Each winner will be notified via email at the email address submitted with the Participant's Submission. The decisions made by the qualified judges chosen by Sponsors, regarding the Contest and related matters, are final. If a potential winner declines to accept the prize, has violated any of these Official Rules, does not respond to the award notification by the date listed on the notification, or is found to be ineligible they will be disqualified and, at Sponsors' discretion, an alternative winner shall be chosen. The winner releases Sponsors, their affiliated companies and all employees, agents, and representatives from all liability and responsibility of any kind which is related in any way to the prize (including without limitation any property loss, damage, personal injury or death) and consent to the use of their names and likenesses for advertising and promotional purposes without additional compensation, except where prohibited by law. Acceptance of a prize shall constitute and signify the winner's agreement and consent that Sponsors may use the winner's name, address (city, state), likeness, and/or prize information for contextual purposes worldwide, including the internet, without limitation and without further payment or consideration, except where prohibited by law.
7. PRIZES: Global Giving is an online marketplace that connects you to the causes and countries you care about. You select the projects you want to support, make a tax-deductible contribution, and get regular progress updates - so you can see your impact. NIKE will make a charitable donation to Global Giving to the project of each winner's choice through a Global Giving Gift Card.
One (1) Grand Prize Winner will receive a NIKE 6.0 prize package, which includes a BMX bike, apparel and shoes, and a $1,000 Global Giving Gift Card, approximate retail value ('ARV'): $575
One (1) Second Place Prize Winner will receive a $750 Global Giving Gift Card
One (1) Third Place Prize Winner will receive $500 Global Giving Gift Card
Eighteen (18) winners will each receive a $500 Global Giving Gift Card
Nine (9) winners will each receive a Beat Gasoline T-Shirt, ARV: $90 ($10 each)
Total ARV for all prizes: $665
Any prize details not specified above will be determined by the Sponsors in their sole discretion. Prizes are not transferable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsors, who reserve the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsors in their sole discretion. The winner is responsible for taxes and any and all other costs and expenses not listed above. Winners that receive Global Giving Gift Cards will not be responsible for taxes on the contribution.
8. GENERAL RULES.
Void where prohibited. This Contest is subject to all applicable Federal, State and local laws and regulations. By entering or participating in the Contest, Participants agree to be bound by these Official Rules. Sponsors assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any Submission or other information, or for the failure to capture any such information. Sponsors is not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries. Further, if for any reason the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsors, may corrupt or effect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winner for the Contest from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsors.
Participants, by participating in this Contest, hereby waive and release, and agree to hold harmless, Sponsors, all Contest and advertising agencies, and their respective parents, subsidiaries, affiliates, and distributors, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity, or any travel related to the Contest or any travel for any prize related activity. Winner also further acknowledges that Sponsors, all Contest and advertising agencies, and their respective parents, subsidiaries, affiliates, and distributors, and all of their respective officers, directors, employees, representatives and agents, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or this Contest including but not limited to quality, condition or fitness for a particular purpose. Except where prohibited, Participant agrees that any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a Federal or State court within the State of Oregon; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant and Sponsors in connection with this Contest, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Oregon or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Oregon.
9. PERSONAL INFORMATION:

10. HOW DO I OBTAIN A WINNERS LIST?
A winners list will be available at www.YouthNoise.com/beatgasoline and posted for approximately two (2) weeks from winner confirmation and is also available by sending a stamped, self addressed envelope to Link Media, inc.
